"Our company was not adequately protected against TCPA call restrictions when reaching out. We found out the hard way: Being out of compliance can be expensive and time-consuming. Now, my primary goal is to get the companies in our internet loan industry protected and compliant as much as possible so that we are not seen as easy pickings by predatory attorneys."

B2B lead providers and callers are struggling with a rash of TCPA litigation. Sean Murray, Editor of the B2B internet loan publication Debanked admits, “Many of my clients are in court, or are answering some pre-litigation demand on the calling rules.” These laws are purposefully vague, traditionally slanted for the cell owner, and now include all wireless calls, not just consumer cells. These “hybrid” wireless numbers on websites (cell numbers used for both private and business communications) can be dangerous to solicit. And now we have the five states banning cell calls altogether. So let’s take a look.

All my fellow B2B Phone Marketers are in TCPA Lawsuits. Why is that?

Top TCPA prosecuting attorneys have discovered easy money with B2B's. Companies making calls to other businesses - most without any TCPA protections. Business to Business callers are now the #1 target of these lawyers. Companies selling factoring, low-end financing, B2B leads, software, employment specialists faxing doctors offices – heck, anyone marketing to other businesses. Don't want to cough up your client list to these guys? Prosecuting attorneys will threaten to sue you personally, piercing your corporate vail if you don’t. But then you may lose your clients. What's going on?

What's with all these Business to Business Robocalls for Loans?

“After a thorough review of your profile, you’ve been pre-approved for a business loan of up to $75,000," says the canned call message. Of course, financial communications like these come from smaller unregulated fiscal participants - and they've recently upped their call volumes. Robo-blasting the business universe with millions of solicitations daily. If you are selling these pre-approved loans, your most important consideration should be predatory TCPA Attorneys serving pre-litigation demands and lawsuit filings against you. Why? Because your B2B call lists are now poisoned with high-litigation-risk cell numbers previously unavailable through Linkedin, Twitter, and Facebook. And very few B2B callers are adequately protecting themselves.

Want to cut down on B2B TCPA Call Complaints? When people say, “Don’t call me.” – Don’t Call Em’!

The FTC and CFPB use complaints as guides for their next Telephone Consumer Protection Act victims. An easy way to cut down on unhappy prospects? - Start listening to people and honoring their requests. Particularly requests not to be called.

“Would you have some time to talk about our services for your business?”

“I’m under mandatory evacuation for a hurricane, and I have to get out of here now!”

“So let me tell you about our services,”  - Doesn't make it.

I make B2B calls, O.K? So don't waste my time with TCPA Solutions I don't need.

As a business to business company owner, you may not know it, but reliable squeaky clean DNC/TCPA compliance solutions are more important than ever. Things like: Cell Scrubbing through a certified provider; a way not to call previous TCPA filers; and registration for the National Do Not Call list. All can be done inexpensively and without much number fallout. Relentless predatory Attorneys will still want to challenge your call prohibition protections, whatever you do. Because you're B2B, and most likely haven't prepared anything to shield yourself against the Telephone Consumer Protection Act. You're a magnet now for TCPA legal teams, whether you like it or not.

TCPA prosecutors are racing like highly trained athletes into competition for first attacks on any company calling other businesses. Most unsuspecting targets entirely devoid of Do-Not-Call or Telephone Consumer Protection Act safeguards. Folks that are going to sue you under these call prohibition statutes have done it before. Or they work for somebody that does it for a living. [Click Video]

Business to Business callers continue to end up in court at an alarming rate. And it will probably get worse before it gets better - as they remain the least prepared group to tangle with seasoned predatory FCC TCPA Attorneys. Throw in all the tip-in traps and intentional banks of cell phones designed to lure unsuspecting marketers - along with express written consents that haven't been updated in years. And you've got a wing ding of a profitable party for litigators. [Click Video]

“I’ve handed that compliance stuff off to a different department. You’ll hear from them if they need anything” says a top B2B survey provider. Too bad. You were so close. The only B2B’s that actually sign up for prudent, proper DNC and TCPA protections are those either in court, or who’s lawyers insist on proper compliance safety – or the ones who have friends that are in court.
